Common use of Amendment and Restatement of the Original Indenture Clause in Contracts

Amendment and Restatement of the Original Indenture. Subject to the satisfaction or waiver of the conditions precedent set forth herein, the Owner Participant, by execution and delivery hereof, requests, authorizes and directs the Owner Trustee to execute and deliver the First Amended and Restated Indenture, and the Owner Trustee and the Indenture Trustee, by execution and delivery hereof, agree to execute and deliver the First Amended and Restated Indenture. Each of the Original Head Lessee, the Parent Guarantor and the Lessee, by execution and delivery hereof, consent to such execution and delivery of the First Amended and Restated Indenture. The First Amended and Restated Indenture shall be effective as of the Restatement Date.
