Amendment by Declarant Sample Clauses

The "Amendment by Declarant" clause grants the declarant—the party who originally established the governing document—the unilateral authority to modify, add to, or remove provisions within that document. Typically, this power is exercised during the early stages of a development or project, before control transitions to an association or other stakeholders, and may be subject to certain limitations such as time frames or the requirement that amendments do not materially affect the rights of others. The core function of this clause is to provide flexibility for the declarant to address unforeseen issues or make necessary adjustments without requiring the consent of other parties, thereby streamlining the process of managing and finalizing the governing documents.
