Common use of Amendment of Agreement Clause in Contracts

Amendment of Agreement. This Agreement may be amended by mutual consent, but the consent of the Trust must be approved (a) by vote of a majority of those members of the Board of Trustees of the Trust who are not parties to this Agreement or interested persons of any such party, cast in person at a meeting called for the purpose of voting on such amendment, and (b) by vote of a majority of the outstanding voting securities of the Trust.

Amendment of Agreement. This Agreement may be amended by mutual consent, but the consent of the Trust must be approved (a) by vote of a majority of those members of the Board of Trustees trustees of the Trust who are not parties to this Agreement or interested persons of any such party, cast in person at a meeting called for the purpose of voting on such amendment, and (b) by vote of the holders of a majority of the outstanding voting securities Shares of the TrustFund.

This Agreement may be amended by mutual consent; however, but such consent on the consent of the Trust must be approved (a) by vote part of a majority of those members of the Board of Trustees of the Trust who are not parties to this Agreement or interested persons of any such party, cast in person at Series requires either a meeting called for the purpose of voting on such amendment, and (b) by vote of a majority of the outstanding voting securities of such Trust Series or a vote of a majority of the Board of Trustees, and in either event, a vote of a majority of the Trustees of the Trust who are not interested persons of the Trust or the Adviser and who have no direct or indirect interest in the operations of the Trust, this Agreement, or the Adviser, cast in person at a meeting called for this purpose.
