Common use of Amendment of Company Agreement Clause in Contracts

Amendment of Company Agreement. Pursuant to Section 18-209(f) of the Delaware Act, an agreement or plan of merger or consolidation approved in accordance with Section 18-209(b) of the Delaware Act may (a) effect any amendment to this Agreement or (b) effect the adoption of a new limited liability company agreement for a limited liability company if it is the Surviving Business Entity. Any such amendment or adoption made pursuant to this Article XIII shall be effective at the effective time or date of the merger or consolidation.

Any such amendment or adoption made pursuant to this Article XIII Section 14.5 shall be effective at the effective time or date of the merger merger, consolidation or consolidationother business combination.

Any such amendment or adoption made pursuant to this Article XIII Section 14.5 shall be effective at the effective time or date of the merger merger, consolidation or consolidationother business combination.
