Common use of Amendment of Plan of Arrangement Clause in Contracts

Amendment of Plan of Arrangement. (a) The Parties may by mutual agreement amend the Plan of Arrangement at any time and from time to time prior to the Effective Time, provided that each such amendment must be: (i) set out in writing; (ii) filed with the Court and, if made following the PhosCan Meeting or Petrus Meeting, approved by the Court; and (iii) communicated to PhosCan Shareholders and Petrus Shareholders if and as required by the Court.‌

Amendment of Plan of Arrangement. (a) The Parties may by mutual agreement agree to amend the Plan of Arrangement at any time and from time to time prior to the Effective Time, provided that each such amendment must be: (i) set out in writing; (ii) filed with the Court and, if made following the PhosCan Meeting or Petrus Focus Meeting, approved by the Court; and (iii) communicated to PhosCan Shareholders and Petrus Shareholders Focus Securityholders if and as required by the Court.‌Court.
