Common use of Amendment of Section 21 Clause in Contracts

Amendment of Section 21. Section 21 of the Rights Agreement is hereby amended by inserting the following sentence after the first sentence of Section 21: “In the event the transfer agency relationship in effect between the Company and the Rights Agent terminates, the Rights Agent will be deemed to resign automatically on the effective date of such termination; and any required notice will be sent by the Company.”

Amendment of Section 21. Section 21 of the Rights Agreement is hereby amended by inserting the following adding a new sentence after the existing first sentence of Section 21as follows: “In the event the transfer agency relationship in effect between the Company and the Rights Agent terminates, the Rights Agent will be deemed to resign have resigned automatically on and be discharged from its duties under this Agreement as of the effective date of such termination; , and the Company shall be responsible for sending any required notice will be sent by the Companynotice.”
