Common use of Amendment of Subcontracts Clause in Contracts

Amendment of Subcontracts. No executed subcontract may be modified or amended by the Contractor, nor shall Contractor fail to exercise any rights, powers, or remedies thereunder, or waive or otherwise acquiesce in any default thereunder, without the prior written consent of Owner. Notwithstanding the foregoing, Contractor may modify or amend a subcontract if such modification or amendment is the result of (i) a Change Order approved and executed by Owner, or (ii) with the Owner’s approval, an adjustment in the coordination of the Work which does not adversely affect the Contract Sum or the Construction Schedule.
