Common use of Amendment of the DES SPA Clause in Contracts

Amendment of the DES SPA. Project Co undertakes not to make any amendment to, or agree to any waiver under, the DES SPA or purport to make any such amendments that would adversely affect the Transporter’s obligations under this Agreement and/or materially increase the Transporter’s costs in respect of its performance of this Agreement, without the prior consent of the Transporter (not to be unreasonably withheld or delayed).
