Common use of Amendment to 2004 Note Purchase Agreement Clause in Contracts

Amendment to 2004 Note Purchase Agreement. The Company shall have delivered to the Noteholders a fully executed copy of that certain Third Amendment to Note Purchase Agreement, dated as of November 6, 2008, by and among the Company and each of the Persons signatory thereto with respect to that certain Note Purchase Agreement, dated as of May 27, 2004, together with each of the other instruments and agreements executed and/or delivered in connection therewith, each certified as true and correct by a Responsible Officer.

Amendment to 2004 Note Purchase Agreement. The Company shall have delivered to the Noteholders a fully executed copy of that certain Third Fourth Amendment to Note Purchase Agreement, dated as of November 6, 2008the date hereof, by and among the Company and each of the Persons signatory thereto with respect to that certain Note Purchase Agreement, dated as of May 27, 2004, together with each of the other instruments and agreements executed and/or delivered in connection therewith, in each certified as true case in form and correct by a Responsible Officersubstance reasonably satisfactory to the Required Holders.

The Company shall have delivered to the Noteholders a fully executed copy of that certain Third Second Amendment to Note Purchase Agreement, dated as of November 6October 23, 2008, by and among the Company and each of the Persons signatory thereto with respect to that certain Note Purchase Agreement, dated as of May 27, 2004, together with each of the other instruments and agreements executed and/or delivered in connection therewith, each certified as true and correct by a Responsible Officer.

Amendment to 2004 Note Purchase Agreement. The Company shall have delivered to the Noteholders a fully executed copy of that certain Third First Amendment to Note Purchase Agreement, dated as of November 6May 31, 20082007, by and among the Company and each of the Persons signatory thereto with respect to that certain Note Purchase Agreement, dated as of May 27, 2004, together with each of the other instruments and agreements executed and/or delivered in connection therewith, each certified as true and correct by a Responsible Officer.
