Amendment to Appendix. 1. APPENDIX 1 to the Credit Agreement is hereby amended as of the Amendment Effective Date by deleting such Appendix in its entirety and inserting in lieu thereof a new appendix to read as set forth on Appendix 1 hereto.
Amendment to Appendix. A of the Agreement (‘Collateral Requirements’) The Eligible Securities in Section 2(b)(xvi) in Appendix A of the Agreement is hereby amended by replacing the words “20%” wherever appearing therein with the words “30%”.
Amendment to Appendix. A to the Participation Agreement to Insert the Definition of “Noneligible Ratio”. Appendix A to the Participation Agreement is amended by inserting in the proper alphabetical location the definition of “Noneligible Ratio” to read in its entirety as follows: “‘Noneligible Ratio’ means, as of any date of determination, a quotient, expressed as a percentage, (a) the numerator of which equals the aggregate amount of Noneligible Amounts advanced to Lessee prior to such date of determination pursuant to Section 2.2 of the Participation Agreement, and (b) the denominator of which equals the aggregate amount of all Advances advanced to Lessee prior to such date of determination pursuant to Section 2.2 of the Participation Agreement.”
Amendment to Appendix. A (PDP Loan Agreement Extracts; Selected Definitions) to the Step-In Agreement Appendix A shall be amended as follows:
Amendment to Appendix. E-2. The Description of "Cash and Cash Equivalents" -- "Closing - Excluded Assets" shall be amended by inserting at the end of the second sentence thereof the following: "except the balances in the TRW REDI ESCROW BANK ACCOUNT - Wellx Xxxgo Account No. 047-0041000 and the IS&S ORANGE COUNTY EMPLOYEE ASSOC BANK ACCOUNT - Wellx Xxxgo Account No. 258508694".
Amendment to Appendix. A OF THE LOAN AGREEMENT; ADDITION OF NEW DEFINITION. Effective as of the date hereof, APPENDIX A of the Loan Agreement is hereby amended to add the following definition hereto in alphabetical order: "ATP - Advanced Technical Products, Inc., a Delaware corporation."
