Amendment to Schedule 8. In Paragraph 11.2 of Schedule 8 the table shall be deleted in its entirety and replaced with the new table set out in Appendix 2 to this Supplemental Agreement.
Amendment to Schedule 8. 7 to the Credit Agreement. Effective as of the date hereof, all references to “Schedule 8.7” in the Credit Agreement are deemed to be references to “Schedule 8.7” attached hereto as Schedule 8.7.
Amendment to Schedule 8. 6.1. Schedule 8.6.1 is hereby deleted and the attached Schedule 8.6.1 is hereby inserted in place thereof and in substitution therefor.
Amendment to Schedule 8. 9 Schedule 8.9 of the Existing Credit Agreement is hereby amended and restated in its entirety to read as attached as Exhibit P.
Amendment to Schedule 8. 5. The Purchase Agreement is hereby amended by deleting Schedule 8.5 thereof in its entirety and substituting in lieu thereof Schedule 8.5 attached hereto.
Amendment to Schedule 8. 5B. Schedule 8.5B to the Credit Agreement is hereby amended and restated in its entirety as set forth on Schedule 8.5B attached hereto as Exhibit A.
Amendment to Schedule 8. 04. Schedule 8.04 is deleted in its entirety and replaced with Schedule 8.04 attached hereto.
Amendment to Schedule 8. 04. Schedule 8.04 of the Loan Agreement is hereby amended by adding to Schedule 8.04 the additional Schedule 8.04(A) attached hereto and incorporated into the Loan Agreement.
Amendment to Schedule 8. 1(m). Schedule 8.1(m) to the Credit Agreement is hereby amended by deleting subsection (iv) of the second paragraph of the “Property Insurance” section contained therein in its entirety and replacing it with the following:
Amendment to Schedule 8. 19. Schedule 8.19 to the Credit Agreement is hereby deleted and replaced in its entirety with the form of Schedule 8.19 attached hereto as Exhibit B. For the sake of clarity, Borrower acknowledges and agrees that, notwithstanding the amendment and restatement of Schedule 8.19, pursuant to the terms Section 8.19(c) of the Credit Agreement, Borrower is prohibited from making any Capital Expenditure payment if a Default or Event of Default is occurring or would SECOND MODIFICATION AGREEMENT (HII Technologies – Credit Agreement) result from such payment, including, but not limited to, under the Fixed Charge Coverage Ratio set forth in Section 8.19(a) of the Credit Agreement.
