Common use of Amendment to Section 13 Clause in Contracts

Amendment to Section 13. Section 13 of the Rights Agreement is hereby amended and supplemented by adding the following sentence at the end thereof: Notwithstanding anything to the contrary in this Agreement, the provisions of Section 13 of this Agreement shall be deemed not to apply to the Merger.
