Amendment to Section : Representations and Warranties of the Company. Section 4.8 of the Development Agreement is hereby amended by adding the following sentence at the end thereof: “From and after June 30, 2007, the definition of the Existing Intellectual Property shall include that certain License Agreement by and between the Company and JHU entered into on or around December 7, 2006, and all other appendices, addenda, amendments, and agreements related thereto (“Second JHU Agreement”, and together with the JHU Agreement, the “JHU Agreements”).”
