Amendments and Modifications to this Agreement. (a) The Parties may by mutual agreement amend or modify any provision of this Agreement or add any provision to this Agreement, including a new appendix, provided that any such amendment or modification is not inconsistent with or contrary to any applicable licence, rule (including the Rule), order of the Board or any provision of this Agreement that has been approved or required by the Board. For greater certainty, an amendment or modification is not contrary to or inconsistent with an applicable licence, rule (including the Rule), order of the Board or provision of this Agreement that has been approved or required by the Board simply by reason of the fact that the applicable licence, rule (including the Rule), order of the Board or provision of this Agreement that has been approved or required by the Board does not expressly contemplate such amendment or modification or is silent on the matter.
