Amendments; Changes; Modifications. This Agreement, Exhibits or Schedules (a) may be amended, supplemented, or modified only by written instrument duly executed by FMC and the Servicer; (b) shall be incorporated into this Agreement (c) shall be binding upon and shall inure to the benefit of the parties hereto and their respective successors and assigns; and (d) except as provided in Section 12 hereof, may not be terminated or assigned by any party hereto without the prior written consent of the other parties provided however the Servicer may subcontract for collections and skiptracing purposes without prior written consent of FMC.
