Common use of Amendments to Finance Documents Clause in Contracts

Amendments to Finance Documents. With effect on and from the Effective Date each of the Finance Documents, shall be, and shall be deemed by this Second Supplemental Agreement to be, amended as follows: (a) the definition of, and references throughout each of the Finance Documents to, the Master Agreement, the Loan Agreement and any of the other Finance Documents shall be construed as if the same referred to the Master Agreement, the Loan Agreement and those Finance Documents as amended by this Second Supplemental Agreement; and (b) by construing references throughout each of the Finance Documents to "this Agreement", "this Deed", "hereunder" and other like expressions as if the same referred to such Finance Documents as amended and supplemented by this Second Supplemental Agreement.

With effect on and from the Effective Date each of the Finance DocumentsDocuments (other than the Loan Agreement and the Corporate Guarantee), shall be, and shall be deemed by this Second Supplemental Agreement to be, amended as follows: (ai) the definition of, and references throughout each of the Finance Documents to, the Master Loan Agreement, the Loan Agreement Corporate Guarantee and any of the other Finance Documents shall be construed as if the same referred to the Master Loan Agreement, the Loan Agreement Corporate Guarantee and those Finance Documents as amended and restated or supplemented by this Second Supplemental Agreement; and (bii) by construing references throughout each of the Finance Documents to "this Agreement", "this Deed", "hereunder" and other like expressions as if the same referred to such Finance Documents as amended and supplemented by this Second Supplemental Agreement.

Amendments to Finance Documents. With effect on and from the Effective Date (and subject to the occurrence of), each of the Finance Documents, Documents (other than the Facility Agreement) shall be, and shall be deemed by this Second Supplemental Agreement Deed to be, amended as follows: (a) the definition of, and references throughout each of the Finance Documents to, to the Master “Facility Agreement, the Loan Agreement ” and any of the other Finance Documents shall be construed as if the same referred to to, respectively: (i) the Master Amended and Restated Facility Agreement, ; and (ii) the Loan Agreement and those other Finance Documents as amended and supplemented by this Second Supplemental AgreementClause 5.2 (Amendments to Finance Documents); and (b) by construing references throughout each of the Finance Documents to "“this Agreement"”, "“this Deed"”, "“hereunder" ” and other like expressions as if the same referred to such those Finance Documents as amended and and/or supplemented by this Second Supplemental AgreementDeed.

With effect on and from (and subject to the occurrence of) the Effective Date Date, each of the Finance Documents, Documents (other than the Facility Agreement and the Shares Security granted by Odysseus) shall be, and shall be deemed by this Second First Supplemental Agreement to be, amended as follows: (a) by construing the definition of, and references throughout each of the Finance Documents to, the Master Agreement, the Loan Facility Agreement and any of the other Finance Documents shall be construed as if the same referred to the Master Agreement, the Loan Facility Agreement and those Finance Documents as amended by this Second First Supplemental Agreement; and (b) by construing references throughout each of the Finance Documents to "“this Agreement"”, "“this Deed"”, "“hereunder" ” and other like expressions as if the same referred to such Finance Documents as amended and supplemented by this Second First Supplemental Agreement.

With effect on and from (and subject to the occurrence of) the Effective Date each of the Finance Documents, Documents (other than the Loan Agreement) shall be, and shall be deemed by this Second First Supplemental Agreement to be, amended as follows: (a) the definition of, and references throughout each of the Finance Documents to, the Master Agreement, the Loan Agreement and any of the other Finance Documents shall be construed as if the same referred to the Master Agreement, the Loan Agreement and those Finance Documents as amended by this Second First Supplemental Agreement; and (b) by construing references throughout each of the Finance Documents to "“this Agreement"”, "“this Deed"”, "“hereunder" ” and other like expressions as if the same referred to such Finance Documents as amended and supplemented by this Second First Supplemental Agreement.

With effect on and from the Effective Date each of the Finance Documents, Documents other than the Loan Agreement and the Mortgages in respect of the Ships shall be, and shall be deemed by this Second Supplemental Agreement to be, amended as follows: (a) the definition of, and references throughout each of the Finance Documents to, the Master Loan Agreement, the Loan Agreement Guarantee and any of the other Finance Documents shall be construed as if the same referred to the Master Loan Agreement, the Loan Agreement Guarantee and those Finance Documents as amended and supplemented by this Second Supplemental Agreement; and and (b) by construing references throughout each of the Finance Documents to "this Agreement", "this Deed", "hereunder" and other like expressions as if the same referred to such Finance Documents as amended and supplemented by this Second Supplemental Agreement.
