Amount of Royalties. The Company shall pay to NTI a royalty equal to seven and one-half percent (7.5%) of Net Sales from the Company’s Business. Royalties shall be paid in United States Dollars to an account or accounts as may be designated by NTI from time to time.
Amount of Royalties. In connection with KLA's sublicense of the ------------------- CATS Falcon Software to an End User, KLA shall pay TEL a royalty equal to [***] of the List Price (as defined below) for each module of the CATS Falcon Software sublicensed by KLA to such End User.
Amount of Royalties. The total amount of royalties described in paragraph (1) that are paid, transferred, or de- posited into the Crow Tribal Trust Fund shall not exceed, in the aggregate, $85,000,000, ex- cluding—
(A) any interest earned on moneys in the Crow Tribal Trust Fund; and
(B) the funds transferred to the Suspension Accounts pursuant to section 1776h of this title.
Amount of Royalties. Horizon hereby agrees to pay to Penwest royalties on Net Sales made during the Marketing Period ("Royalties"), as follows: [***]-CONFIDENTIAL TREATMENT REQUESTED
5.3.1 [***] of Net Sales on all Net Sales until cumulative Net Sales of [***] U.S. dollars (US$[***]) have been attained;
5.3.2 [***] of Net Sales on all Net Sales after cumulative Net Sales of [***] U.S. dollars (US$[***]) have been attained until cumulative Net Sales of [***] US. dollars (US$[***]) have been attained; and
5.3.3 [***] of Net Sales on all Net Sales after Net Sales of [***] U.S. dollars (US$[***]) have been attained. Such Royalties shall be reduced by [***] (e.g. a [***] Royalty would become a [***] Royalty) with respect to Net Sales of a Designated Product as to which (a) no license to Penwest Patents or to patent applications or patents included in the Joint Developments or TIMERx Improvements hereunder is applicable to the manufacture, sale or use of such Designated Product, or (b) a license to a patent application included in the Penwest Patents, Joint Developments or TIMERx Improvements is applicable to the manufacture, sale or use of such Designated Product, but no patent has yet issued thereon; provided, however, that, with respect to Section 5.3.3(b), (i) as of the date of issue of any such patent, the unreduced Royalty shall become payable on all subsequent Net Sales of such Designated Product and (ii) within ten (10) days following such date, Horizon shall pay to Penwest an amount equal to the unreduced Royalty that would have been payable on Net Sales of such Designated Product up until such date less the total amount of Royalties already paid on such sales.
Amount of Royalties. Lessee shall pay to Lessor a royalty, as provided in this Section, for all pink, red, and gold landscape rock and fines (“material”) removed from the Premises. The amount of material removed shall be determined from the weight of the material loaded into trucks leaving the Premises. All material so removed shall be weighed over scales provided and operated by Lessee. During the year June 1,2008, to November 30,2008, the royalties shall be $5.00 per ton for the landscape rock and $3.00 per ton for the landscape fines, and during each subsequent year the royalties shall be increased by an amount to be determined by the sand and gravel index published by the US Department of Commerce. The term “year”, as used herein means a period of twelve months commencing with the Effective Date of this Lease and each twelve-month period commencing on the anniversary of the Effective Date.
Amount of Royalties. As Licensor's sole compensation for the ------------------- rights and licenses granted by it to Licensee pursuant to Paragraph 2 and technical assistance to be provided by Licensor hereunder, Licensee shall pay to Licensor the following fees and royalties:
(a) a one time, non-refundable, non-creditable disclosure fee of One Million Dollars ($1,000,000.00) (the "Disclosure Fee") payable by Licensee to Licensor in immediately available funds within twenty-four (24) months of the date of this Agreement, according to Indian law and the schedule attached hereto as Exhibit B, in consideration solely for Licensor's disclosure of the Licensed Technology existing on the date of this Agreement;

During the first 3 years, the royalties shall be $0.50 per ton, and during each subsequent year the royalties shall be increased by an amount to be determined by the sand and gravel index published by the US Department of Commerce. The term "year", as used herein means a period of twelve months commencing with the Effective Date of this Lease and each twelve-month period commencing on the anniversary of the Effective Date.
