ANNUAL APPROPRIATION AND PLAN OF FINANCE. The financial obligations of the Owner contained in this Agreement are subject to annual appropriation and availability of funds for the Project. , and the Owner shall be bound under this Agreement only to the extent that there are funds available to perform its obligations hereunder.
