Common use of Annual Excess Energy Clause in Contracts

Annual Excess Energy. Notwithstanding the foregoing, if, at any point in any Contract Year, the amount of Facility Energy exceeds one hundred fifteen percent (115%) of the Expected Energy for such Contract Year, the price to be paid for such additional Facility Energy amounts shall be $0.00/MWh.

Annual Excess Energy. Notwithstanding the foregoing, if, at any point in any Contract Year, the amount of Facility Energy plus the amount of Deemed Delivered Energy exceeds one hundred fifteen percent (115%) of the Expected Energy for such Contract Year, the price to be paid for such additional Facility Energy amounts (but not Deemed Delivered Energy, for which no additional compensation shall be $0.00/MWhpaid) shall be fifty percent (50%) of the Renewable Rate.
