Anticipated Commencement Date. It is presently anticipated that the Premises will be delivered to Tenant on or about April 1, 2022 (“Anticipated Commencement Date”); provided, however, that if Landlord does not deliver possession of the Premises by such date, Landlord shall not have any liability whatsoever, and this Lease shall not be rendered void or voidable, as a result thereof. Such right of termination may be exercised by Tenant only during the period commencing on the ninety-first (91st) day after the Anticipated Commencement Date and continuing through the tenth (10th) business day thereafter, and if such right is not exercised by Tenant by said tenth (10th) business day, such right shall thereafter lapse and be of no further force or effect. If this Lease is terminated pursuant to this subsection, then neither party shall have any further obligations or liability hereunder to the other party; provided, however, that Landlord shall promptly refund any and all security deposits or advance rent previously deposited by Tenant with Landlord in accordance with the provisions of this Lease. Notwithstanding the foregoing, the Anticipated Commencement Date shall be extended on a day-for-day basis for each day the Commencement Date is delayed as a result of any of the factors or causes described in Section 21.11.
