Antitrust Violations. City and Consultant recognize that in actual economic practice overcharges resulting from antitrust violations are in fact borne by City. Therefore, Consultant assigns to City any and all claims for such overcharges. Consultant in all subcontracts shall require all subcontractors to likewise assign all claims for overcharges to City.
Antitrust Violations. The Authorized User agrees to not bring suit for alleged antitrust violations on the basis of this DUA.

Antitrust Violations. The Vendor, the Department, and the State recognize that, in actual practice, overcharges resulting from antitrust violations are, in fact, borne by the purchaser. Therefore, the Vendor hereby assigns to the Department and the State any and all claims for such overcharges.
Antitrust Violations. The Contractor has a continuous duty to disclose to the City if it or any of its affiliates (as defined by Section 287.137(1)(a), Florida Statutes) are placed on the Antitrust Violator Vendor List. A person or an affiliate who has been placed on the antitrust violator vendor list following a conviction or being held civilly liable for an antitrust violation may not submit a bid, proposal, or reply for any new contract to provide any goods or services to a public entity; may not submit a bid, proposal, or reply for a new contract with a public entity for the construction or repair of a public building or public work; may not submit a bid, proposal, or reply on new leases of real property to a public entity; may not be awarded or perform work as a contractor, supplier, subcontractor, or consultant under a new contract with a public entity; and may not transact new business with a public entity. By entering this Agreement, Contractor certifies that neither it nor its affiliate(s) are on the antitrust violator vendor list at the time of entering this Agreement. False certification under this paragraph or being subsequently added to that list will result in termination of this Agreement, at the option of the City consistent with Section 287.137, Fla. Stat. as amended.
Antitrust Violations. To permit the City to recover damages suffered in antitrust violations, Contractor hereby assigns to Owner any and all claims for overcharges associated with this Contract which are under the antitrust laws of the United States, 15 U.S.C.A., Sec. 1 et. seq. (1973). The Contractor shall include this provision in its agreements with each Subcontractor and supplier. Each Subcontractor shall include such provision in agreements with sub-subcontractors and suppliers.
Antitrust Violations. Vendor and WSDOT recognize that, in actual economic practice, overcharges resulting from antitrust violations are usually borne by the purchaser. Therefore, Vendor hereby assigns to WSDOT any and all claims for such overcharges as to goods, Deliverables, and Services purchased in connection with this Contract, except as to overcharges not passed on to WSDOT resulting from antitrust violations commencing after the date of the bid, quotation, or other event establishing the Price under this Contract. The provisions in this Section shall survive the expiration or termination of this Contract.
Antitrust Violations. 325 Lessor assigns to the State any claim for overcharges resulting from antitrust violations to 326 the extent that such violations concern materials or services supplied by third parties to the 327 Lessor toward fulfillment of this lease. 328
Antitrust Violations. CONTRACTOR and the CONSORTIUM recognize that overcharges resulting from antitrust violations are in actual economic practice usually borne by the CONSORTIUM. Therefore, CONTRACTOR hereby assigns to the CONSORTIUM any and all claims for such overcharges as to goods and Services purchased in connection with this Agreement, except as to overcharges not passed on to the CONSORTIUM resulting from antitrust violations commencing after the date of the bid, quotation, or other event establishing the charges under this Agreement.
