Bidding. Subject to these Conditions, the highest bidder (being so determined by the Auctioneer) shall be the Purchaser. The Auctioneer may refuse any bid or bids without giving any reasons. No bid shall be withdrawn or be less that the last previous bid. Subject to the reserve price, the Auctioneer shall fix the sum to commence bidding and regulate the advance of each subsequent bid. The Auctioneer shall have the absolute right to withdraw the property at any time before the fall of the hammer, and either after or without declaring the reserve price. If any dispute shall arise as to bidding the Auctioneer’s decision shall be final and conclusive.

The bidder shall follow the bidding procedure as provided in the Auctioneer’s Online Terms and Conditions. e. Each bid will be called for 3 times, “First Calling, “Second Calling”, “Final Call”. Bidders may submit their bid at any of these stages of biddings. When system displays “No More Bids”, no further bids will be accepted by the Auctioneer. f. No bid shall be less than the last previous bid and each bid shall be increased by a minimum amount to be determined by the Auctioneer at the time the Property is put up for sale. g. The Auctioneer shall have the absolute right to withdraw the Property for sale at any time before the fall of the hammer and either after or without declaring the reserve price. h. In case of any dispute as to any bid, the Auctioneer may at his own option forthwith determine the dispute or put the Property up for sale again at the reserve price or at the last undisputed bid or withdraw the Property from the auction sale. The Auctioneer’s decision therein shall be final and conclusive. i. Subject to these Conditions of Sale and particularly to the reserve price, the highest bidder being so allowed or determined by the Auctioneer shall be the Purchaser upon the fall of hammer.
BiddingSelection of employees to fill a posted vacancy shall be made from among eligible bidders in order of Classification Seniority (State Seniority for Units 4 and 6), provided the senior employee's ability and capacity to perform the job are relatively equal to that of other bidders. Bidders for Unit 6 positions must be position-qualified. [Note: for a posted vacancy in a Junior/Senior Plan, Classification Seniority is the combined Class Seniority of classes in the Junior/Senior Plan.] Vacancies shall be filled by the posting and bidding process until there is no bid or until a maximum of three (3) such vacancies have been filled, whichever comes first. However, when a vacancy can be filled by an employee who has received notice of permanent layoff, only one (1) vacancy shall be filled by the posting and bidding process. All bidders for a vacancy shall be notified, orally or in writing, of the acceptance or rejection of their bid in a timely manner. When an employee returns from an approved leave of absence and there is a vacancy, the employee shall be reinstated to that vacancy, provided that no employee with more Classification Seniority (State Seniority for Units 4 and 6) has bid on the position. If a more senior employee has successfully bid on the position, the employee returning from the approved leave of absence shall be selected for the position vacated by the successful bidder. (See also Article 10, Section 6, regarding return from a leave of absence.) Notwithstanding the above, the Appointing Authority shall not consider bids by employees for vacancies if acceptance of a bid would create a layoff or a bumping situation nor accept a bid from an employee in a different employment condition if acceptance of the bid would prevent the recall of an employee from the Seniority Unit Layoff List laid off from the same class, employment condition and location.

BiddingThe Agent shall promptly after receipt by it of a Bid Loan Request pursuant to Section 2.08(a) notify the Banks of its receipt of such Bid Loan Request specifying (i) the identity of the applicable Borrower, (ii) the proposed Bid Loan Borrowing Date, (iii) whether the proposed Bid Loan shall be a Fixed Rate Bid Loan or a LIBOR Bid Loan, (iv) the Bid Loan Interest Period, (v) the principal amount of the proposed Bid Loan and (vi) the Approved Currency for such Bid Loan. Each Bank may submit a bid (a “Bid”) to the Agent by telephone (immediately confirmed in writing by letter, facsimile, email, or telex) not later than the following (each, as applicable, a “Bid Deadline”): 10:00 A.M. New York time two (2) Business Day before the proposed Bid Loan Borrowing Date if the applicable Borrower is requesting a Fixed Rate Bid Loan or 10:00 A.M. New York time three (3) Business Days before the proposed Bid Loan Borrowing Date if the applicable Borrower is requesting a LIBOR Bid Loan of one, two, three, or six months’ duration. Each Bid shall specify: (A) the principal amount of proposed Bid Loans offered by such Bank (the “Offered Amount”) which (i) may be less than, but shall not exceed, the Requested Amount, (ii) shall be at least $1,000,000 and shall be an integral multiple of $1,000,000 and (iii) may exceed such Bank’s Revolving Credit Commitment; and (B) the Fixed Rate which shall apply to such proposed Bid Loan if the applicable Borrower has requested a Fixed Rate Bid Loan or the LIBOR Bid Loan Spread which shall apply to such proposed Bid Loan if the applicable Borrower has requested a LIBOR Bid Loan and which may be a positive or negative number. If any Bid omits information required hereunder, the Agent may in its sole discretion attempt to notify the Bank submitting such Bid. If the Agent so notifies a Bank, such Bank may resubmit its Bid, provided that it does so prior to the applicable Bid Deadline. The Agent shall promptly notify the applicable Borrower of the Bids which it timely received from the Banks. If the Agent in its capacity as a Bank shall, in its sole discretion, make a Bid, it shall notify the Borrower of such Bid at least one-half hour before the applicable Bid Deadline.
BiddingThe County shall assure that the same or lower costs and the same or improved benefit levels are maintained and that medical care shall be transitioned consistent with "industry standards" when health care providers are changed. The Union shall participate to the full extent allowed by law, rule, and regulation in the entire bidding process. Participation shall include, but not be limited to, consultation and provision of information.
Bidding. Bidding begins immediately upon the launch of the auction on our web site. Preliminary bidding will end at published closing time (for example, 11:00 PM, EST) on the auction closing date. To bid on a lot after 11:00 PM, EST you must have placed a bid on that lot prior to 11:00 PM, EST. Thus, if you are the only bidder on a lot at 11:00 PM, EST on the auction closing date, the auction software will disallow additional bidding for that lot and you will be declared the winner. Bidding prior to 11:00 PM, EST as well as after 11:00 PM, EST (the latter regulated by the 15Minute Rule), may occur in any of the following ways: a) Online Bidding - Online bidding for registered users who have obtained a User ID and Password is available 24 hours. Beginning at 11:00 PM, EST on the auction closing date, bidding will be extended in accordance with the terms of the "15-Minute Rule" (with all items ending at the same time). After 11:00 PM, EST "Time Left" in the user interface will count down in real time the amount of time remaining until such time as no lots receive even a single bid for a period of approximately 15 minutes at which time the auction will officially close and "Time Left" will read "Auction Has Ended."
BiddingFollowing the Department’s approval of the design development documents, the Design-Builder shall manage the trade bidding process in accordance with the approved bidding procedures and shall use commercially reasonable best efforts to solicit at least three (3) qualified and bona fide bids for each trade package that has an expected value in excess of One Hundred Thousand Dollars ($100,000.00). Trade packages shall not be parceled, split or divided to avoid the $100,000.00 threshold. In addition to the information normally required in such bids, the Design-Builder shall also require subcontractors to provide an estimate of the percentage of labor hours performed in completing the subcontracted work which will be performed by District residents. The Design-Builder shall carefully document its procedures for making available bid packages to potential bidders, the contents of each bid package, discussions with bidders at any pre-bid meetings, bidders’ compliance with bid requirements, all bids received, the Design Builder’s evaluations of all bids, and the basis for the Design-Builder’s recommendation as to which bidders should be chosen. The Department shall be afforded access to all such records at all reasonable times so that, among other things, it may independently confirm the Design Builder’s adherence to all requirements set forth in the Agreement, including, without limitation, affirmative action requirements and subcontracting requirements.

Bidding. 1. At least five (5) days before the Bid Meeting, the Board shall post the list of available Route Packages which shall note the start time and end time of each route, the school(s) serviced, summary of the stops, the total estimated drive time for each Route and Route Package, and whether the Route or Route Package includes services to private and/or parochial schools. Nothing in this Article prevents the Board from starting certain Routes or Route Packages prior to the Bid Meeting based on the needs, calendars and schedules associated with such Routes or Route Packages, and such work shall be offered to bargaining unit members in descending order of Classification seniority for a temporary assignment until the completion of bidding provided such work is bargaining unit work as defined in this Article. 2. At least five (5) days before the start of classes each year, Bus Drivers shall attend the Bid Meeting to bid on available Route Packages and Routes. At the Bid Meeting, the Director of Transportation/Assistant Director of Transportation shall be present, and the Bus Drivers shall bid in descending order of Classification seniority on available Route Packages and Routes provided that each such Bus Driver has completed and successfully passed an annual physical examination in accordance with applicable state regulations and further that the combination of a Bus Driver’s selected Route Package and Route(s) (excluding Pre-Route and Post-Route Serving) may not exceed seven and one- half (7½) hours per day or thirty-seven and one-half (37½) hours per week. Such annual physical examinations shall be made available to bargaining unit members, at the Board’s cost, by the end of each fiscal year. 3. Any Routes and/or Route Packages not available for bidding at the Bid Meeting shall be subject to the bidding procedures herein when such Routes and/or Route Packages become available. 4. The Routes and Route Packages shall contain the estimated drive time for each Route or Route Package, the number of driving days, and the relevant school calendars, if available. Each Bus Driver shall have no more than fifteen (15) minutes to select an available Route and/or Route Package. 5. In the event that a Bus Driver has not completed the annual physical examination and in-service training in accord with applicable state regulations provided such in-service is scheduled prior to bidding, the Bus Driver will not be eligible to participate in bidding and/or driving for the Board ...
