The Appeal Board clause establishes a designated body or panel responsible for reviewing and deciding on appeals arising from disputes or decisions made under the agreement. Typically, this clause outlines the composition of the board, the process for submitting an appeal, and the procedures the board will follow in considering and resolving the matter. Its core function is to provide a structured and impartial mechanism for parties to challenge decisions, thereby ensuring fairness and due process in the resolution of disagreements.
Appeal Board. 1. An Appeal Board,* composed of the following six (6) persons, will be established:
a. the Superintendent of Perry Township Schools or his/her designee,
b. the PEA President or his/her designee,
c. two (2) members appointed by the Superintendent of Perry Township Schools, and
d. two (2) members appointed by the PEA President. *(Note: No appointed member of the SBC may at the same time be a member of the Appeal Board.)
2. The PEA President or his/her designee will act as Chairperson of the Appeal Board.
3. If a request for use of sick leave days is denied by the SBC, then the applicant may appeal the SBC’s decision to the Appeal Board within ten (10) working days after the denial. All decisions made by the Appeal Board must be based on a majority vote. All decisions of the Appeal Board are final and binding.
4. The Appeal Board will rule on any appeal within ten (10) working days after receiving the appeal in writing.

Appeal Board. Classified Review Board (CRB) shall consist of four (4) members: two (2) Association members 12 and two (2) administrative members. One (1) of the Association selected members may rotate from a 13 group of Association approved members. The Human Resources Director shall serve as a non-voting 14 resource to the CRB and provide administrative support. Each party will be responsible for selecting its 15 own members. The Director of OEO will ensure all members of the Appeal Board receive additional training on how to conduct appeals in a thorough, impartial, and fair manner.

When an appellate review is requested, the Board may sit as the appeal board or it may appoint an appeal board which shall be composed of Board members and shall have at least three members. Knowledge of the matter involved shall not preclude any person from serving as a member of the appeal board, so long as that person did not take part in a prior hearing on the same matter or act as accuser, investigator, fact finder, or initial decision maker in the same matter. Members shall gain no financial benefit from the outcome. The appeal board may select an unbiased attorney to assist it in the proceeding, but that attorney shall not be entitled to vote with respect to the appeal. The attorney selected by the Board shall not be the attorney that represented either party at the hearing before the Trier of Fact.
