Appeal of Claim Determination. The DDPOK Plan, or a designee, shall have the right to resolve any questions concerning dental services or treatment which may arise hereunder and any such determination made in good faith shall be binding upon all parties. DDPOK will provide participants and beneficiaries upon request, without charge, a copy of the Claim and Appeal Policy and Procedures, or participants and beneficiaries may obtain a copy at their Contractor’s benefit office. No action at suit of law or equity shall be commenced upon or under this Plan Agreement until thirty (30) days after notice of claim has been given to DDPOK, nor shall action be brought at all later than three (3) years after such claim has arisen.
