Appellate Matters. Irrespective of any authorization to engage in litigation in this OCC, or in a writing outside of this OCC, the Agency will notify the OAG and give the OAG the opportunity to take up representation of Agency in any appellate matter. Outside Counsel is not authorized to file any document or make any public statement on any appeal, in any capacity, whether interlocutory or otherwise, whether as appellant, appellee, respondent, applicant, or otherwise, sooner than 14 days after Agency has notified OAG, unless Agency notifies Outside Counsel that it has received approval from OAG and expressly authorizes making the filing or public statement prior to 14 days after Agency has notified OAG.
