Common use of Applicability of Article 8 of the Base Indenture Clause in Contracts

Applicability of Article 8 of the Base Indenture. Article 8 of the Base Indenture shall not apply to the Notes. Instead, the provisions set forth in this Article 3 shall, with respect to the Notes, supersede in its entirety Article 8 of the Base Indenture and all references in the Base Indenture to satisfaction and discharge of the Notes pursuant to Article 8 thereof and the provisions therein, as the case may be, shall, with respect to the Notes, be deemed to be references to this Article 3 and the provisions set forth in this Article 3. The Notes shall not be subject to defeasance.
