Common use of Applicability of Article Five of the Base Indenture Clause in Contracts

Applicability of Article Five of the Base Indenture. For purposes of the Notes, this Article 5 shall replace in its entirety Article Five of the Base Indenture, and all references in the Base Indenture to Article Five thereof and the provisions therein, as the case may be, shall, with respect to the Notes, be deemed to be references to this Article 5 and the applicable provisions set forth in this Article 5, respectively; provided, however, that Section 5.15 of the Base Indenture will apply to the Notes.

Instead, the provisions set forth in this Article 6 shall, with respect to the Notes, this Article 5 shall replace supersede in its entirety Article Five of the Base Indenture, Indenture and all references in the Base Indenture to Article Five thereof and the provisions therein, as the case may be, shall, with respect to the Notes, be deemed to be references to this Article 5 6 and the applicable provisions set forth in this Article 5, respectively; provided, however, that Section 5.15 of the Base Indenture will apply to the Notes6.
