Common use of Applicability of Article IX of the Base Indenture Clause in Contracts

Applicability of Article IX of the Base Indenture. Article IX of the Base Indenture shall not apply to the Notes. Instead, the provisions of this Article VIII shall, with respect to the Notes, supersede in its entirety Article IX of the Base Indenture and all references in the Base Indenture to Article IX thereof and the provisions therein, as the case may be, shall, with respect to the Notes, be deemed to be references to this Article VIII and the applicable provisions set forth in this Article VIII, respectively.

Instead, Instead the provisions of set forth in this Article VIII 10 shall, with respect to the Notes, supersede in its their entirety Article IX of the Base Indenture Indenture, and all references in the Base Indenture to Article IX thereof and the provisions therein, as the case may be, shall, with respect to the Notes, be deemed to be references to this Article VIII and 10 or the applicable provisions set forth in this Article VIII10, respectively.
