Applicability of Bonus. Buyer shall pay Seller a Capacity Bonus if both (a) the Average Summer Super Peak Availability exceeds the Guaranteed Summer Super Peak Availability and (b) the Average Summer Partial Peak Availability exceeds the Guaranteed Partial Peak Availability; provided, however, if the Summer Super Peak Availability during any Summer Period month is less than or equal to 80%, then Seller shall not be entitled to a Capacity Bonus.
