Applicability of ISP98. Unless otherwise expressly agreed by the L/C Issuer and the Borrower when a Letter of Credit is issued (including any such agreement applicable to an Existing Letter of Credit), the rules of the “International Standby Practices 1998” published by the Institute of International Banking Law & Practice (or such later version thereof as may be in effect at the time of issuance) shall apply to each Letter of Credit.

Applicability of ISP98. Unless otherwise expressly agreed by the L/C Issuer ---------------------- and the Borrower when a Letter of Credit is issued (including any such agreement and subject to applicable to an Existing Letter of Credit)laws, the rules of the “"International Standby Practices 1998” " (ISP98) or such later revision as may be published by the Institute International Chamber of International Banking Law & Practice (or such later version thereof as may be in effect at the time of issuance) Commerce shall apply to each Letter of Credit; provided, that with respect to the Existing Letters of Credit, such Letters of Credit shall be governed by the rules of the International Chamber of Commerce set forth therein.

Applicability of ISP98. Unless otherwise expressly agreed by the relevant L/C Issuer and the Borrower when a Letter of Credit is issued issued, (including any such agreement applicable to an Existing Letter of Credit), i) the rules of the “International Standby Practices 1998” published by the Institute of International Banking Law & Practice (or such later version thereof as may be in effect at the time of issuance) shall apply to each Letter of Credit.

Unless otherwise expressly agreed by the L/C Issuer Bank and the Borrower when a Letter of Credit is issued (including any such agreement applicable to an Existing Letter of Credit)issued, the rules of the “"International Standby Practices 1998” " published by the Institute of International Banking Law & Practice (or such later version thereof as may be in effect at the time of issuance) shall apply to each Letter of Credit.

Unless otherwise expressly agreed by the L/C Issuer relevant Issuing Bank and the Borrower when a Letter of Credit is issued (including any such agreement applicable to an Existing Letter of Credit)issued, the rules of the “International Standby Practices 1998” published by the Institute of International Banking Law & Practice (or such later version thereof as may be in effect at the time of issuance) ), and, to the extent not inconsistent therewith, the law of the State of New York, shall apply to each such Letter of Credit.

Unless otherwise expressly agreed by the L/C Issuer and the Borrower BioReliance when a Letter of Credit is issued (including any such agreement applicable to an Existing Letter of Credit)issued, the rules of the “International Standby Practices 1998” published by the Institute of International Banking Law & Practice (or such later version thereof as may be in effect at the time of issuance) shall apply to each Letter of Credit.

Unless otherwise expressly agreed by the L/C Issuer Agent and the applicable Borrower when a Letter of Credit is issued issued, (including any such agreement applicable to an Existing Letter of Credit), i) the rules of the “International Standby Practices "INTERNATIONAL STANDBY PRACTICES 1998” " published by the Institute of International Banking Bank Law & Practice (or such later version thereof as may be in effect at the time of issuance) shall apply to each Letter of Credit.

Applicability of ISP98. Unless otherwise expressly agreed by the L/C Issuer and the Borrower when a Letter of Credit is issued (including any such agreement applicable to an Existing Letter of Credit), the rules of the “"International Standby Practices 1998” " published by the Institute of 46 International Banking Law & Practice (or such later version thereof as may be in effect at the time of issuance) shall apply to each Letter of Credit.

Applicability of ISP98. Unless otherwise expressly agreed by the L/C Issuer and ---------------------- the Borrower when a Letter of Credit is issued (including any such agreement and subject to applicable to an Existing Letter of Credit)laws, the rules of the “"International Standby Practices 1998” " (ISP98) or such later revision as may be published by the Institute International Chamber of International Banking Law & Practice (or such later version thereof as may be in effect at the time of issuance) Commerce shall apply to each Letter of Credit; provided, that with respect to the Existing Letters of Credit, such Letters of Credit shall be governed by the rules of the International Chamber of Commerce set forth therein.

Unless otherwise expressly agreed by the L/C Issuer Issuing Bank and the Borrower US Borrowers or the Foreign Borrower, as the case may be, when a Letter of Credit is issued (including any such agreement applicable to an Existing Letter of Credit)issued, the rules of the “International Standby Practices 1998” published by the Institute of International Banking Law & Practice (or such later version thereof as may be in effect at the time of issuance) shall apply to each Letter of Credit.
