Applicable Conditions. 29.1 This Agreement will continue in respect of each Service for the Minimum Term applicable to each Service and thereafter unless and until terminated in accordance with this Agreement.
29.2 These Conditions apply to the provision of all Services.
29.3 Where we publish separate conditions for specific Services, both conditions will apply but those conditions will take precedence over these Conditions in the event of inconsistencies between them.
29.4 These Conditions in their entirety shall take precedence over any terms which may form your purchase order for any of the Services.

Applicable Conditions. 1.1 This Call-off Contract is governed by the provisions of the Framework Agreement, in so far as this Contract does not depart from it. The terms written with initial capitals in this Call-off Contract are defined in the Framework Agreement. The term ‘Contract’ in the ARVODI 2016 is to be read as ‘Call-off Contract’ for the purpose of this Contract.
1.2 The conditions included in the Quotation (including price indexation, discounts and guarantees) do not apply in so far as they are less favourable for the Contracting Authority than those included the Framework Agreement.
Applicable Conditions. All deliveries and services by us are exclusively based on these conditions and, if applicable, on separate contractual arrangements. General terms and conditions of purchase or other diverging, conflicting or supplementing general terms and conditions of the Customer only become a component of this agreement, if we expressly agree to their validity. Individual arrangements entered into between us and the Customer in the individual case take priority over these General Terms and Conditions. Subject to proof to the contrary, a written agreement between us and the Customer or our written confirmation to the Customer is decisive for the content of such individual arrangements. In case of new duties, taxes, customs or similar additional costs due to the withdrawal of the United Kingdom from the European Union, those additional expenses will be solely paid by the Customer of us. In addition, we are entitled to terminate this agreement with formal notice to the other party if a modification of applicable laws in connection with the withdrawal of the United Kingdom from the European Union changes the circumstances of the agreement significantly. Significant changes shall include but are not limited to:
I. The contractually obliged provision or receipt of goods or services is rendered impossible.
II. If the continuation of the contract would place a substantial and significant financial burden on us.
Applicable Conditions. All harvesting activities pursuant to commercial fishing licenses or similar authorizations shall be subject to laws of general application.
Applicable Conditions. This agreement is conditioned upon the happening of each of the following events. If each of the same has not occurred within the time stated, this offer shall be null and void, and any Deposit returned to Buyer.

Apart from these rates, the Specific Conditions for each Services forming a container continue to apply to the relevant Service. Each container is subscribed for the duration of this Agreement. In the event of the cancellation of one container, Fuzer reserves the right to claim a compensation equal to 50% of the total of the monthly fees of said container that would have been due until the end of this Agreement. Calls to destination that are not included in the containers or that are in excess of the containers will be charged in accordance with pay as you go (PAYG) tariff plan that are is available from Fuzer and can be consulted on the relevant product website which the Client can find

Calls to destination that are not included in the container or that are in excess of the containers will be charged in accordance with pay as you go (PAYG) tariff plan. The unused volume of containers is not transferred to the following month.
Applicable Conditions. Notwithstanding any other provision of this Agreement, MLC’s obligations under this Article XII are subject to (i) PESRM’s compliance with its obligations under this Article XII, (ii) (x) the availability of Refined Product supply from the third party suppliers, and (y) the available demand for Crude Oil from the third party purchasers, in each case, of the types and grades, and in the volumes, at the differentials and on the delivery dates specified by PESRM in the applicable Cover Request, (iii) if applicable, the availability of the Required Infrastructure to receive or make delivery at the delivery point specified for such Cover Transaction, and (iv) no PESRM Event of Default or Termination Event having occurred. For the avoidance of doubt, any Applicable Condition described in subclause (ii) and (iii) above shall only excuse or suspend MLC’s duty to perform its obligations with respect to the affected or corresponding Cover Transactions.
