Common use of Application by Fiscal Agent or Italian Paying Agent Clause in Contracts

Application by Fiscal Agent or Italian Paying Agent. The Fiscal Agent or the Italian Paying Agent, as the case may be, shall apply each amount paid to it hereunder in accordance with Clause 8 (Payments to Securityholders) and shall not be obliged to repay any such amount unless the claim for the relevant payment becomes void or otherwise ceases in accordance with the Conditions, in which event it shall refund at the written request of the relevant Issuer or (as the case may be) the Guarantor, where applicable, such portion of such amount as relates to such payment by paying the same by credit transfer to such account with such bank as the relevant Issuer or (as the case may be) the Guarantor, where applicable, has by notice to the Fiscal Agent or the Italian Paying Agent, as the case may be, specified for the purpose.

The Fiscal Agent or the Italian Paying Agent, as the case may be, shall apply each amount paid to it hereunder in accordance with Clause 8 6.6 (Payments to SecurityholdersNoteholders) and shall not be obliged to repay any such amount unless the claim for the relevant payment becomes void under Condition 7 (Prescription) of the Terms and Conditions of the English Law Notes and/or Condition 7 (Prescription) of the Terms and Conditions of the Italian Law Notes, or otherwise ceases in accordance with the Conditions, in which event it shall refund at the written request of the relevant Issuer or (as the case may be) the Guarantor, where applicable, such portion of such amount as relates to such payment by paying the same by credit transfer to such account with such bank as the relevant Issuer or (as the case may be) the Guarantor, where applicable, has by notice to the Fiscal Agent or the Italian Paying Agent, as the case may be, specified for the purpose.
