Common use of Application of Voluntary Prepayments Clause in Contracts

Application of Voluntary Prepayments. Any prepayment of any Term Loan pursuant to Section 2.14(a) shall be applied as specified by the Borrower in the applicable notice of prepayment; provided that in the event the Borrower fails to specify the Term Loans to which any such prepayment shall be applied, such prepayment shall be applied to prepay the Term Loans in direct order of maturity of the scheduled remaining Installments of principal of the Term Loans.

Any prepayment of any Class of Term Loan pursuant to this Section 2.14(a) 4.1 shall be applied as specified by the Borrower in the applicable notice of prepayment, ratably among the Lenders; provided that provided, in the event the Borrower fails to specify the Class of Term Loans to which any such prepayment shall be applied, such prepayment shall be applied ratably to prepay succeeding scheduled principal installments under the Term Loans in direct order of maturity of the scheduled remaining Installments of principal of the Term LoansLoan Facility.
