Application under New Issues. If the Client requests and authorizes the Broker to apply for an issue of a new listing of Securities on the Exchange as agent for the Client, the Client shall provide the following warranty to the Broker: (a) that the Broker has due authority to make such application on behalf of the Client; (b) that on other application is being made for the benefit of the Client by the Client itself or by any person other than the Broker applying as the Client’s agent; and (c) that the Broker is duly authorized to provide a warranty to the Exchange on the application form that no other application is being made by the Client or by any other person as agent for the Client.
