APPOINTMENT AND EMPLOYMENT. (i) The Employer shall provide each Employee with a Position Description. All Employees covered by this Agreement shall be appointed to a particular job and demonstrate the inherent requirements of that job through the satisfactory performance of duties as contained within a Position Description. The duties as provided by the Employer and accepted by the Employee may be varied from time to time, within the scope of the Employee’s skills, qualifications and abilities. (ii) The Employer shall provide each Employee with a Letter of Appointment detailing the individual Employee’s role, capacity and employment status. Employees may be employed in a permanent or casual capacity. Permanent positions shall occupy a full time or part time status. Full time and part time employees will have their average minimum hours per week recorded in their Letter of Appointment. Such hours may be averaged over a week, a fortnight or a month. (iii) Subject to applicable Workers’ Compensation legislation, where the inherent requirements of the job for which the employee was employed, can no longer be carried out to their full extent by the individual, Just Better Care retains the right to invoke the termination provisions of this Agreement.. (iv) In the event of a transmission of business between Just Better Care and a purchaser, of the whole or part of the business, nothing contained within this Collective Agreement shall preclude the Employer from transmitting the employment of those Employees covered by this Agreement and the terms and conditions of this Agreement to such purchaser.
