Common use of APPOINTMENT AND FUNCTION OF AGENT Clause in Contracts

APPOINTMENT AND FUNCTION OF AGENT. FINOVA is hereby appointed as Agent hereunder to act in such capacity on behalf of all Lenders under this Loan Agreement and the other Loan Instruments. FINOVA agrees that it shall continue to act as Agent throughout the term of the Loan. In performing its functions and duties under this Agreement, Agent shall act solely as an agent of Lenders and does not assume and shall not be deemed to have assumed any obligation towards or relationship of agency or trust with or for any other Person. Notwithstanding the appointment of FINOVA as Agent hereunder, Agent shall have the same rights hereunder as any other Lender, and may exercise such rights as though FINOVA had not been appointed as Agent hereunder.
