Common use of Appointment of ABF Clause in Contracts

Appointment of ABF. The Client hereby appoints ABF to manage the Plan with full DISCRETIONARY authority. ABF shall supervise and direct, in its sole discretion, the portfolio of and for the Plan. Client agrees to promptly notify ABF in writing of any changes to its Plan, and any changes to the instructions applicable to the Plan, and to provide ABF with prior written notice of any changes in the identity of persons authorized to act on behalf of the Client with respect to the Plan. This appointment includes the appointment of ABF as agent and attorney-in-fact with full and exclusive power and authority for and on behalf of the Plan to manage client’s portfolio.
