Common use of APPOINTMENT OF ASSISTANT CLAIMS ADMINISTRATOR Clause in Contracts

APPOINTMENT OF ASSISTANT CLAIMS ADMINISTRATOR. The Claims Administrator hereby appoints TMS Mortgage Inc., a New Jersey corporation, as Assistant Claims Administrator and, in such capacity, the Assistant Claims Administrator shall have all the rights, powers, obligations and duties of the Claims Administrator in acting in such capacity. Notwithstanding such appointment, the Claims Administrator shall remain obligated to the Trustee, the Co-Trustee and the Certificateholders in accordance with the provisions of this Agreement.

Notwithstanding such appointment, the Claims Administrator shall remain obligated to the Trustee, the Owner Trustee (and with respect to FHA Loans, the Co-Trustee Trustee), the Noteholders and the Certificateholders in accordance with the provisions of this Agreement.

The FHA Custodian and the Claims Administrator hereby appoints appoint TMS Mortgage Inc., a New Jersey corporation, as Assistant Claims Administrator and, in such capacity, the Assistant Claims Administrator shall have all the rights, powers, obligations and duties of the Claims Administrator in acting in such capacity. Notwithstanding such appointment, the Claims Administrator shall remain obligated to the Trustee, the Co-Trustee FHA Custodian and the Certificateholders in accordance with the provisions of this Agreement.
