Common use of APPOINTMENT OF CO-SECURITY TRUSTEE OR SEPARATE SECURITY TRUSTEE Clause in Contracts

APPOINTMENT OF CO-SECURITY TRUSTEE OR SEPARATE SECURITY TRUSTEE. 11.6.1 Notwithstanding any other provisions of this Deed, at any time, for the purpose of meeting any legal requirements of any jurisdiction in which any part of the Secured Property in respect of any Series may at the time be located, the Security Trustee shall have the power and may execute and deliver all instruments to appoint one or more Persons to act as a co-Security Trustee or co-Security Trustees, or separate Security Trustee or separate Security Trustees, with respect to all or any part of the Secured Property in respect of any Series, and to vest in such Person or Persons, in such capacity and for the benefit of the Secured Creditors of the relevant Series, such title to the Secured Property in respect of any Series or any part thereof, and, subject to the other provisions of this Clause 11.6, such powers, duties, obligations, rights and trusts as the Security Trustee may consider necessary or desirable. No notice to Secured Creditors of the relevant Series of the appointment of any co-Security Trustee or separate Security Trustee shall be required under Clause 11.5 hereof.

APPOINTMENT OF CO-SECURITY TRUSTEE OR SEPARATE SECURITY TRUSTEE. 11.6.1 13.5.1 Notwithstanding any other provisions of this Deed, at any time, for the purpose of meeting any legal requirements of any jurisdiction in which any part of the Secured Property in respect of any Series may at the time be located, the Security Trustee shall have the power and may execute and deliver all instruments to appoint one or more Persons persons (for the avoidance of doubt, not being the Loan Note Issuer) to act as a co-Security Trustee or co-co- Security Trustees, or separate Security Trustee or separate Security Trustees, with respect to all or any part of the Secured Property in respect of any SeriesSeries of Loan Notes, and to vest in such Person person or Personspersons, in such capacity and for the benefit of the Secured Creditors of the relevant SeriesSeries of Loan Notes, such title to the Secured Property in respect of any Series of Loan Notes or any part thereof, and, subject to the other provisions of this Clause 11.613.5, such powers, duties, obligations, rights and trusts trusts, as the Security Trustee may consider necessary or desirable. No notice to Secured Creditors of the relevant Series of the appointment of any co-Security Trustee or separate Security Trustee shall be required under Clause 11.5 hereof13.4 (Successor Security Trustee).

No notice to Secured Creditors of the relevant Series of the appointment of any co-Security Trustee or separate Security Trustee shall be required under Clause 11.5 (Successor Security Trustee) hereof.
