Common use of Appointment of Eligible Lender Trustee Clause in Contracts

Appointment of Eligible Lender Trustee. The Depositor hereby appoints the Eligible Lender Trustee as trustee of the Trust effective as of the date hereof, to have all the rights, powers and duties set forth herein. Bank One Delaware, Inc. is appointed the initial Delaware Trustee. The Delaware Trustee shall not have any of the powers or duties of the Eligible Lender Trustee or of a trustee generally set forth herein, except as required under the Delaware Business Trust Act. The Delaware Trustee shall be a trustee hereunder for the sole and limited purpose of fulfilling the requirements of Section 3807(a) of the Delaware Business Trust Act.
