Appointment of Spread Account Custodian. The Spread Account Depositor and the Trustee hereby appoint Marine Midland Bank as their agent under this Agreement to act on their behalf in accordance with the terms of this Agreement with respect to their interests in the Account and all amounts and investments deposited therein or credited thereto. Marine Midland Bank hereby accepts and acknowledges its appointment as agent on behalf of the Spread Account Depositor and the Trustee.
