Common use of Appointment of the Subadviser Clause in Contracts

Appointment of the Subadviser. In accordance with and subject to the Management Agreement between the Trust and the Adviser (the "Management Agreement"), the Trust hereby appoints the Subadviser to act as subadviser with respect to the Portfolio for the period and on the terms set forth in this Agreement. The Subadviser accepts such appointment and agrees to provide an investment program with respect to the Portfolio for the compensation provided by this Agreement.

Appointment of the Subadviser. In accordance with and subject to the Management Agreement between the Trust and the Adviser Manager (the "Management Agreement"), the Trust hereby appoints the Subadviser to act as subadviser with respect to each of the Portfolio Funds for the period and on the terms set forth in this Agreement.
