Appointment of the Trustee for the Notes. Section 3.01. Pursuant and subject to the Indenture, the Company and the Trustee hereby constitute the Trustee as trustee to act on behalf of the Holders of the Notes, effective upon execution and delivery of this First Supplemental Indenture.
