Common use of Appointment of Trustee; Acceptance by Trustee Clause in Contracts

Appointment of Trustee; Acceptance by Trustee. Pursuant and subject to the Original Indenture, the Issuer hereby appoints U.S. Bank National Association to act on behalf of the Holders of the Notes. By execution, acknowledgment and delivery of this Ninth Supplemental Indenture, the Trustee hereby accepts appointment as trustee with respect to the Notes, and agrees to perform the duties and obligations of the Trustee with respect to the Notes upon the terms and conditions set forth in the Original Indenture and in this Ninth Supplemental Indenture.
