Common use of Appointment of USBFS as Administrator Clause in Contracts

Appointment of USBFS as Administrator. The Trust hereby appoints USBFS as administrator of the Trust on the terms and conditions set forth in this Agreement, and USBFS hereby accepts such appointment and agrees to perform the services and duties set forth in this Agreement (which shall include any addendum hereto which is hereby incorporated herein and made a part of this Agreement). The services and duties of USBFS shall be confined to those matters expressly set forth herein, provided, however, that in the event any additional services and duties materially increase the services and duties of USBFS hereunder, the parties agree to amend this Agreement to reflect such increased services and duties. Except as contemplated hereby, no implied duties are assumed by or may be asserted against USBFS hereunder.

The Trust Each Fund hereby appoints USBFS as administrator of the Trust Funds on the terms and conditions set forth in this Agreement, and USBFS hereby accepts such appointment and agrees to perform the services and duties set forth in this Agreement (which shall include any addendum hereto which is hereby incorporated herein and made a part of this Agreement). The services and duties of USBFS shall be confined to those matters expressly set forth herein, herein as well as any additional services and duties that are customarily provided by investment company administrators; provided, however, that in the any event any such additional services and duties materially increase the services and duties of USBFS hereunder, the parties agree to amend this Agreement to reflect such increased services and duties. Except as contemplated hereby, no other implied duties are assumed by or may be asserted against USBFS hereunder.
