Approval by Operating Committee Sample Clauses

Approval by Operating Committee. ‌ (a) By executing this Deed, the Applicant applies to become a AAP Lender under the AAP and agrees, from notice of acceptance of this application, to be bound by the terms hereof. (b) This Deed becomes binding on the date that is the earlier of:‌ (i) the date that the Operating Committee or the ASP (as agent for the Operating Committee) gives notice to the Applicant that the Applicant has been accepted as a participant in the Project by the Operating Committee; and (ii) the date that the ASP first requests a non-binding expression of interest (EOI) from the Applicant in accordance with clause 1.5 of this Deed.‌ (c) On the occurrence of either event under clause 1.1(b), the Applicant becomes a AAP Lender for the purposes of this Deed and the AAP.
