Common use of Approval of Final Report Clause in Contracts

Approval of Final Report. (a) The Department, in its sole discretion, may approve the Final Report if the Final Report addresses the requirements of clauses 4.1 and 4.2(a) of this Agreement. (b) If, in the Department's opinion, the Final Report is incomplete or does not meet the requirements of clauses 4.1 and 4.2(a) of this Agreement, or any other Submission Items remain outstanding or do not meet the requirements of this Agreement, the Department will notify the Recipient and the Recipient must address the requirements or provide the outstanding or revised Submission Items as notified by the Department to the Department's satisfaction as soon as reasonably practicable and by no later than the last day of the Confidentiality Period. (c) If the Recipient fails to comply with clause 4.4(b) of this Agreement and the Department has not extended the date for compliance under clause 6 of this Agreement: (i) the Recipient relinquishes all entitlement to funding under this Agreement; and (ii) the Department is under no obligation to provide any funding that the Recipient would otherwise have been entitled to under clause 5 of this Agreement.
