Approval of Subsequent Appraisal Operations by Fewer Than All Parties. If a proposal for Subsequent Appraisal Operations (except a proposal to plug and abandon), is approved by the Election of at least fifty percent (50%) interest of the then Participating Parties' interest, but by fewer than all then Participating Parties, then the Operator (or substitute Operator) shall conduct the operation at the sole Cost and risk of the Participating Parties. Any Non- Participating Party in a Subsequent Appraisal Operation shall be subject to Article 16 (Non-Consent Operations). A Non-Participating Party in a Subsequent Appraisal Operation shall be relieved of the Costs, risks and obligations of the Subsequent Appraisal Operation, except as to its share of the Costs of plugging and abandoning the Appraisal Well in its then-current condition. No operation shall be performed on the well unless deemed by the Operator to be safe and the well bore is in a condition to perform the proposed operation.
