Approvals & Licences for the Project. 5.5.1. The Licensee shall observe and conform to all Applicable Laws relating to its business the Property Business Space, the Property Business Space in any way and in particular but not limited to all public and labour related issues including health and sanitation in force for the time being. The Licensee shall ensure and shall remain responsible that its Contractors and End Users shall also adhere with Applicable Laws as required in the Agreement. 5.5.2. The Licensee shall at all times, obtain and keep valid all Applicable Permits, which are required by Applicable Law, to undertake the Project/Property Business Space. The licensee shall at all times comply all laws in force in India. 5.5.3. Without prejudice to the foregoing: o The Licensee and its Contractors shall be responsible to ensure compliance with the provision of the Minimum Wages Act, 1948 and the Rules made thereunder. o The Licensee and its Contractors shall be responsible to ensure compliance with the provisions of the Apprentice Act, 1961 and the Rules and orders issued thereunder from time to time in respect of apprentices. o The Licensee and its Sub-Contractors shall comply with the provisions of the Payment of Wages Act, 1936 and the rules thereunder. o The Licensee shall comply with the provisions of all labour laws, rules & Regulations in force and as modified from time to time, where ever applicable. o The Licensee shall be responsible for the safety of all employees directly or through Contractor employed by it on the Project and shall report serious accidents to any of them however and wherever occurring on the Licensed premises to Maha-Metro Representative and shall make every arrangement to render all possible assistance. o For the purposes of all Applicable Laws, the Licensee shall be deemed to be the principal employer of all workers working at the Licensed premises. The Licensee shall indemnify Maha-Metro from and against any Liabilities under any of the Acts or Rules thereunder mentioned in this Article or any other Applicable Laws, and in case through order of any Government Authority, Maha-Metro has to pay any compensation in respect of the Licensed premises, Maha-Metro shall recover such amount of compensation so paid from the Security Deposit or the Escrow Account or otherwise from the Licensee under these conditions.

The Licensee shall be responsible for the safety of all employees directly or through Contractor employed by it on the Project and shall report serious accidents to any of them however and wherever occurring on the Licensed premises to Maha-Metro the Authority Representative or the Authority Representative’s Representative and shall make every arrangement to render all possible assistance. vi. o The Licensee shall observe and make its Contractors observe and perform all the provisions of the Mines Act,1952 or any statutory modifications or re-enactments thereof for the time being in force and any rule and regulations made thereunder. vii. For the purposes of all Applicable Laws, the Licensee shall be deemed to be the principal employer of all workers working at the Licensed premises. The Licensee shall indemnify Maha-Metro Authority from and against any Liabilities under any of the Acts or Rules thereunder mentioned in this Article or any other Applicable Laws, and in case through order of any Government Authority, Maha-Metro Authority or the Railway has to pay any compensation in respect of the Licensed premises, Maha-Metro Authority shall recover such amount of compensation so paid from the Security Deposit or the Escrow Account or otherwise from the Licensee under these conditions.

(c) The Licensee Developer and its Sub-Contractors shall comply with the provisions of the Payment of Wages Act, 1936 and the rules thereunder. o . (d) The Licensee Developer shall comply with the provisions provision of all labour lawsthe Contract Labour (Regulation and Abolition) Act, rules & Regulations in force 1970 and the Contract Labour (Regulation and Abolition) Central Rules 1971 as modified from time to time, where ever applicable. o . (e) The Licensee Developer shall be responsible for the safety of all employees directly or through Contractor though Sub-Contracts employed by it on the Project and shall report serious accidents to any of them however and wherever whereever occurring on the Licensed premises Project to Maha-Metro the Nodal Officer or the Nodal Officer’s Representative and shall make every arrangement arrangements to render all possible assistance. o . (f) The Developer shall observe and make its Sub-Contractors observe and perform all the provisions of the Xxxxx Xxx,0000 or any statutory modifications or re-enactments thereof for the time being in force and any rule and regulations made thereunder. (g) For the purposes of all Applicable Laws, the Licensee Developer shall be deemed to be the principal employer of all workers working at the Licensed premisesProject. The Licensee shall indemnify Maha-Metro Developer indemnifies IRSDC, RLDA and the Railway from and against any Liabilities claim under any of the Acts or Rules thereunder mentioned in this Article or any other Applicable Laws, and in case through order of any Government Authority, Maha-Metro IRSDC or RLDA or the Railway has to pay any compensation in respect of the Licensed premisesProject, Maha-Metro IRSDC shall recover such amount of compensation so paid from the Security Deposit or the Escrow Account or otherwise from the Licensee Developer under these conditions.
