Approvals; Permits. Purchaser shall assist Provider in obtaining all necessary approvals and permits including but not limited to those related to the Local Electric Utility, any Governmental Authority, and any waivers, approvals or releases required pursuant to any applicable CCR.
Approvals; Permits. Consultant represents that it and its subconsultants have experience and knowledge of the applicable approval and permit application requirements of any governmental jurisdiction and shall be responsible to provide the Services in the form and at the time required to obtain such approvals or permits. To the extent required by Exhibit A, Consultant shall assist District in preparing and submitting any such applications and will execute such applications on District’s behalf. Approvals; Permits. Design Build Entity, its Design Professional, Subcontractors, consultants, and inspectors shall provide documentation required for all approvals by Authorities Having Jurisdiction.
13.19.3.1. During Construction Work, the OSFM will conduct periodic field reviews of the Work. Notwithstanding OSFM stamped and approved plans, the OSFM has the authority to require revisions and/or corrections to secure code compliance based on its field review and inspection findings. These corrections, when ordered by the OSFM to achieve code compliance, shall be provided by Design Build Entity without any adjustment to the Contract Time or Total Contract Amount, unless otherwise permitted, consistent with the requirements of the Contract Documents.
13.19.3.2. Design Build Entity shall notify Judicial Council and the Project Inspector of required inspections and shall provide reasonable access and accommodations for inspections, including not less than 48 hours’ notice.
13.19.3.3. Design Build Entity shall plan and anticipate for a typical duration of five (5) days from request to performance of OSFM inspections.

Provider shall secure and maintain, at its own expense, all permits, including but not limited to environmental permits, licenses, and those related to the Local Electric Utility, any Governmental Authority, and any waivers, approvals or releases required pursuant to any applicable CCR. If Purchaser is a New York State Agency, OGS Design & Construction division, or other State construction-permitting agency as defined in 19 NYCRR 1204.3(e), shall provide all Uniform Code services which shall include (i) the issuances of all permits and certificates, (ii) inspections, and

(a) Provider shall obtain all necessary approvals from the Local Electric Utility, including the submission of applications for interconnection of the System with the Local Electric Utility. Host shall provide commercially reasonable assistance to Provider in obtaining necessary approvals from the Local Electric Utility and the necessary local Governmental Approvals for the System in accordance with Section 7.1 and Section 7.2, which may include provision by Host of electrical drawings and structural drawings for the Property.
(b) If the Local Electric Utility fails to approve the interconnection of the System or requires equipment in addition to that shown in Schedule 2 of the Appendix, Host and Provider may agree that necessary repairs or changes are needed to the existing electrical structure of the Property required by the Local Electric Utility or any state inspection for interconnection of the System; in such case, Host and Provider shall share in the costs of repairs or changes with Host paying fifty percent (50%) of the costs and Provider paying fifty percent (50%) of the costs. If Host and Provider do not agree to make such repairs or changes, then Provider shall have the option to re- engineer the System, at Provider’s sole expense, in a manner that is satisfactory to Host and satisfies the Local Electric Utility and/or Governmental Authority requirements for interconnection of the System. If Provider does not elect to re-engineer the System on the Property or cannot do so to Host’s satisfaction, then Provider and Host shall explore, in good faith, the relocation of the System to an alternative Host site where interconnection of the System with the Local Electric Utility can be accomplished in a timely manner without significant cost to the Parties. If no such alternative Host site can be agreed upon by the Parties, then either Party may, in its sole discretion, terminate this agreement by written notice without cost or liability (except pursuant to any provisions of this Agreement that survive termination pursuant to Section 19. 6). Upon such termination by Provider, Host shall have no obligation to pay an Early Termination Fee.
(c) Provider shall ensure that the completed System complies with all requirements for eligibility for the Utility incentive program (e.g., NRES). The Borrower shall have obtained all ------------------ Federal, state and local governmental and regulatory consents, approvals, Licenses and permits, including any third-party consents, as required or necessary for the Borrower to borrow Loans hereunder and continue with the construction and development of the New York PCS Network as contemplated for the current stage of construction and development on the Closing Date and operate its business pursuant to the Full Term Operating Business Plan, and all such consents, approvals, Licenses and permits shall remain in effect; all applicable waiting periods shall have expired without any action being taken by any competent authority; no law or regulation shall be applicable in the judgment of the Lenders that restrains, prevents or imposes materially adverse conditions upon the Loans or the construction and development of the New York PCS Network referred to above or the operation of the Borrower's business pursuant to the Full Term Operating Business Plan and the Administrative Agent shall receive a certificate of an authorized officer of the Borrower to that effect dated the Closing Date.
